2. Ordering Process and Contract Formation

2.1 Order Placement

All orders placed through our Service are an offer to purchase the products listed in your order. It is your responsibility to ensure the accuracy of your order, including the specific items, quantities, delivery/pickup details, and payment information.

2.2 Order Acceptance

The contract of sale is not formed until we send you a confirmation email or notification that your order has been accepted, confirmed, and/or is being prepared for pickup or delivery. We reserve the right to accept or reject any order at our sole discretion, including for reasons related to ingredient availability, pricing errors, or service capacity.

2.3 Pricing and Payment

3.1 Product Descriptions

We strive to provide accurate descriptions and images of our products. However, as food is prepared by hand, slight variations in color, size, and appearance may occur.

3.2 Allergens and Dietary Information

Guaiquerí Empanadas cannot guarantee a completely allergen-free environment.

  • Our products may contain, or come into contact with, common allergens, including but not limited to wheat (gluten), milk, eggs, nuts, soy, and shellfish.

  • While we make every effort to label known allergens, cross-contamination is possible.

  • If you have a life-threatening allergy, we strongly advise you not to order through the Service. Please contact us directly by phone at 808.222.2666 to discuss your options.

  • By placing an order, you accept the inherent risk associated with potential cross-contamination in food preparation and agree that Guaiquerí Empanadas is not liable for any allergic reaction.

4. Delivery and Pickup

4.1 Risk of Loss (Perishable Goods)

Our products are perishable. The risk of loss or damage to the goods transfers to you upon hand-off to you (for pickup) or upon delivery to the address you provided (for delivery).

4.2 Responsibility for Delivery Details

You are solely responsible for providing an accurate and complete delivery address. We accept no liability for late, non-delivery, or deterioration of the goods due to incorrect or incomplete delivery information provided by you.

4.3 Delays and Service Availability

We will endeavor to meet the requested delivery or pickup time, but we cannot guarantee exact times. Delays may occur due to unforeseen circumstances (e.g., weather, traffic, equipment issues). We are not liable for any loss or inconvenience caused by delays.

4.4 Unattended Delivery (If Applicable)

If you request that the order be left unattended (e.g., at your doorstep), you acknowledge and accept that:

  • We are not responsible for the security or condition of the food after it is left.

  • The risk of spoilage or theft passes to you immediately upon delivery.

5. Cancellations and Refunds

5.1 Customer Cancellation

Due to the made-to-order and perishable nature of our products, once an order confirmation is sent, the preparation process has begun. Therefore, we generally do not permit cancellations.

  • Any request for cancellation must be made immediately by calling 808.222.2666. We reserve the right to refuse a cancellation request if the order is already in preparation.

5.2 Refunds and Replacements

Refunds and replacements are governed by our separate Refund Policy (as previously provided), which is incorporated into these Terms by reference. We only provide refunds or replacements for issues related to quality or order accuracy at the time of delivery or pickup, provided you notify us within the specified time frame.

6. Intellectual Property

All content on the Service, including text, graphics, logos, images, and the unique recipes and branding of “Guaiquerí Empanadas,” is our exclusive property and protected by copyright and intellectual property laws. You may not use, reproduce, or distribute any content from the Service without our express written permission.

7. Limitation of Liability

To the fullest extent permitted by law, Guaiquerí Empanadas, its affiliates, officers, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service; (c) any content obtained from the service; and (d) unauthorized access, use or alteration of your transmissions or content.

8. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Honolulu/Hawaii U.S.A, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Honolulu/Hawaii U.S.A to resolve any legal matter arising from these Terms.
